Perla Laxmi v. State Of Andhra Pradesh
HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.31963 of 2015 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Revenue.
The petitioners seek grant of pattadar passbooks and title deeds for the land admeasuring Ac.5.48 cents in Survey No.299 of Rajaiahpeta Village, Nakkapalli Mandal, Visakhapatnam District. It is stated that they have made representations, dated 24.01.2005 and 17.08.2015, before the Mandal Revenue Officer, Narasipatnam Village, Nakkapally Mandal, Visakhapatnam District, the 4t h respondent and the District Collector, Visakhapatnam District, the 2nd respondent, respectively. Alleging inaction on the part of the respondents, the present Writ Petition is filed.
It is evident from the record that the petitioners have not made any application under Form VI-A read with Rule 18 of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971, apart from paying the requisite fee in Mee-Seva. Hence, unless the petitioners make appropriate application before the competent authority, the relief sought for by the petitioners in the Writ Petition cannot be granted to them.
The Writ Petition is, accordingly, disposed of giving liberty to the petitioners to make appropriate application before the competent authority in accordance with law. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
