SIVA SANKARA RAO C.M.A.No.1686 of 2004 JUDGMENT: The 2nd respondent-insurer i.e., United India Insurance Company Limited, among two respondents, including the owner of the bus bearing registration No.TCY 8386, aggrieved by the claim maintained by two claimants, who are parents of the deceased, by name T.

Naveen Kumar Reddy, aged about 8 years at the time of accident that occurred on 30.9.1997, as per Ex.A.2 photostat copy of Postmortem Certificate, under Section 166 of Motor Vehicles Act, 1988 (for brevity "the Act") for a compensation of Rs.1,85,000/-, since awarded Rs.1,52,000/- with interest at 9% per annum fixing joint liability, by order and decree dated 19.2.2002 in M.V.O.P.No.137 of 1998, passed by the Motor Accident Claims Tribunal-cum-District Judge, Kadapa, maintained this appeal with the contentions in the grounds of appeal as well as submissions by Sri A.V.K.S. Prasad, learned Standing Counsel for the appellant-insurer, that the Tribunal gravely erred in fixing joint liability inspite of the fact that the driver of the offending bus not having valid driving licence at the time of accident that is proved by the evidence of R.W.

1 and Exs.B.2 and B.3, certified true copy of driving licence and extract of B.2 licence, showing the defective licence, as well as Ex.B.4 attested copy of charge sheet, under which the driver was charged under Section 181 of the Act for not having a valid driving licence and to exonerate the insurer from the liability and hence sought for recovery of compensation from the owner of the offending bus, that the rate of interest at 9% per annum awarded by the Tribunal is also excessive to reduce the same. 2. Whereas, it is the contention of the learned counsel for 1st respondent-sole claimant, out of two claimants since the 2nd claimant died, and the factum of the 1st claimant as her legal representative was already recorded by order dated 26.3.2004, that as the 3rd respondent to the appeal and respondent No.

1 in the claim petition, who is the owner of the offending bus, remained exparte, but for no cross-objections, the compensation awarded is utterly low to enhance and there is nothing to interfere from the joint liability fixed by the Tribunal and hence sought for dismissal of the appeal.

3. Perused the material on record. The parties are being referred to as they are arrayed before the Tribunal. 4. Now the points that arise for consideration are:-- (i) Whether the compensation and the rate of interest awarded by the Tribunal are excessive, so also the joint liability fixed by the Tribunal is untenable and the insurer is to be exonerated from the liability, either totally or to the extent of pay and recover and, if so, with what observations? and (ii) To what result? In re. Point No.1 : 5.

The fact that the accident was the result of rash and negligent driving on the part of the driver of the bus belonging to the 1st respondent to the claim petition and the vehicle is insured with the 2nd respondent-insurer is not in dispute, but for the rate of interest at 9% per annum claimed as excessive and on fixing of joint liability, impugning to exonerate the insurer. 6. Coming to the joint liability and its correctness, for nothing to interfere with the finding that the accident is the outcome of rash and negligent driving by the driver of the bus belonging to the 1st respondent to the claim petition, even from Exs.B.2 and B.3 filed by the insurer through a witness as R.W.1, that there was L.M.V. Non-transport licence, which the driver of the 1st respondent bus possessed, whereas the bus is a transport vehicle.

No doubt, as per Section 9 of the Act, possessing of Transport Licence is not automatic even after obtaining Non-transport, but for the fact that after a certain period of experience and on passing of tests in perfection, since there is a lot of difference between a transport and non-transport vehicle, for the reason that in the case of transport vehicle, he is entitled to drive public transport vehicles and heavy goods vehicles even in Highways and even the passengers that involves the risk of life, it is therefrom the driver of the bus belonging to the 1st respondent did not possess a valid driving licence and has possessed a non-transport licence and the Tribunal has gravely went wrong in observing that the owner was not issued notice to produce licence, even Exs.B.2 = B.

3 filed, which is the certified true copy of driving licence, that could not be disputed either from the claimant and from the 1st respondent, since remained exparte. Further, the charge sheet also corroborated the fact of the driver of the bus is not having a valid driving licence at the time of accident and for which he was charged under Section 181 of the Act. Once that is the evidence produced, which is unchallenged, much less unrebutted, it is wrong on the part of the Tribunal in saying that a particular procedure is not adopted by not calling the owner of the vehicle. Thus the Tribunal is not right in fixing joint liability.

However, though the insurer claims total exoneration from liability, there is nothing to show that owner of the bus deliberately and consciously allowed the driver of the bus with no licence to drive the vehicle. Apart from that, once Ex.B.1 policy covers the risk, the insurer cannot be exonerated from indemnifying the third party claimant; but for to pay to the claimants and recover from owner insured of the vehicle as per the settled expressions of the Apex Court in UNITED INDIA INSURANCE CO. LTD. V. LEHRU​, NATIONAL INSURANCE COMPANY LIMITED VS. SWARAN SINGH & OTHERS​ and ORIENTAL INSURANCE COMPANY LIMITED VS.

NANJAPPAN & OTHERS​ in holding that from lack of license or fake license or imperfect or defective license, the insurer can be ordered firstly to satisfy the claimants by indemnifying the owner and then recover from owner and driver; i) Even in the subsequent expressions of the Apex Court in KUSUMLATHA AND OTHERS V. SATBIR AND OTHERS​ it was held that the Tribunal has got inherent power to issue such directions to insurer to pay and recover. ii) Even in the recent expression of the High Court in JAYA PRAKASH AGARWAL V. MOHD. KALIMULLA having considered the law at length taken similar view, while saying at para-39 that each case has to be decided on its own facts and circumstances. iii) Even in the latest expression of the Apex Court in S.IYYAPPAN VS.

UNITED INDIA INSURANCE COMPANY​ a two judge bench of the Apex Court held that even though the insurer has taken the defence that there is a breach of conditions of the policy excluding from liability, from the driver is not duly licenced in driving the crime vehicle when met with accident, third party has a statutory right under Section 149 read with 168 of the Act to recover compensation from insurer and it was for the insurer to proceed against the insured for recovery of amount paid to third party in case there was any fundamental breach of condition of Insurance policy. 7. From the above legal principles and in the factual matrix of case, it is a fit case for pay and recover including from the above expressions of the Apex Court in SWARAN SINGH (supra), LEHRU (supra), NANJAPPAN (supra), KUSUMLATA (supra) and S.IYYAPPAN (supra). 8.

Having regard to the above, it is the insurer also along with the insured owner of the crime vehicle jointly and severally liable to pay compensation to the claimant and then it is for the insurer to recover from the owner of the vehicle by filing execution petition in the same award without need of any separate proceedings. 9. Coming to the contention that the rate of interest at 9% awarded by the Tribunal is excessive, from the settled proposition of law in TN TRANSPORT CORPORATION v. RAJA PRIYA​ and RAJESH v. RAJBIR SINGH​, the rate of interest is reduced from 9% per annum to 7.5% per annum from the date of claim petition till realization. 10. Accordingly, point No.1 for consideration is answered. In re. Point No.2 : 11. Accordingly and in the result, while allowing the appeal in part and while modifying the rate of interest from 9% p.

a. to 7.5% p.a. from the date of claim petition till the date of realization with joint and several liability of the insured and insurer (respondents 1 and 2) to pay by the insurer and then to recover. The respondents shall deposit said amount within one month, failing which the claimant can execute and recover. It is made clear from the settled expressions of the Apex Court in LEHRU (supra) & NANJAPPAN (supra) that the insurer is entitled, while depositing the amount payable, if not deposited or paid any amount so far to deposit in bank to approach the Tribunal to direct the RTA concerned not to register any transfer of the crime vehicle and to seek for attachment of the crime vehicle or other property of the insured as an assurance for execution and recovery in the same proceedings or under revenue recovery as per the M.V.

Act, 1988 and also ask the Tribunal not to disburse the deposited amount to claimant (but for to invest in a bank) till such attachment order is made. However, after the same, the Tribunal shall not withhold the amount of the claimant, if there is any necessity to permit for any withdrawal but for to invest the balance in fixed deposit in a nationalized bank. Rest of the terms of the award of the Tribunal holds good. There is no order as to costs. 12.
