THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.37188 of 2015 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) This writ petition was filed assailing the possession notice issued by the respondent bank and published in the newspapers on 30.10.2015 in pursuance of the proceedings initiated by it under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.
By order dated 17.11.2015, this Court granted interim stay of further proceedings pursuant to the impugned possession notice subject to the petitioners depositing 50% of the amount due as per the demand notice dated 15.07.2015 within four weeks. In the event the amount was not deposited within the time stipulated, the respondent bank was given liberty to take further steps without reference to the pendency of these proceedings.
Sri Naga Praveen Vankayalapati, learned counsel for the petitioners, would fairly state that the afore-stated conditional order has not been complied with.
Sri P.V. Uma Shankara Rao, learned counsel for the respondent bank, would state that the respondent bank has proceeded in the matter in accordance with law.
That being so, the cause in this writ petition does not survive for consideration on merits.
The writ petition is accordingly dismissed leaving all issues open. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
