THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.31985 OF 2015 ORDER:

The petitioner was appointed as fair price shop dealer of shop No.17, Annaluru Village, Mydukur Mandal, Kadapa District, after due process of selection. The authorization of the petitioner is valid up to 31.03.2017. However, based on the report of the Tahsildar, Mydukur Mandal, dated 17.08.2015, the third respondent issued a show cause notice dated 29.08.2015 and the petitioner submitted his explanation on 07.09.2015. After receipt of explanation, the authorization of the petitioner was suspended on 18.09.2015. Challenging the same, the present Writ Petition is filed. Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies for the respondents.

A reading of the impugned order of suspension shows that four allegations were levelled against the petitioner, in respect of which the authorities have come to a prima facie conclusion. The authorization was suspended for a period of three months pending further enquiry. In view of pendency of enquiry before the third respondent, this Court is not inclined to interfere with the enquiry process at this stage. However, the third respondent is directed to complete the enquiry by giving due opportunity to the petitioner and pass final orders thereon within the period of suspension mentioned in the impugned order dated 18.09.2015. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed. ________________________ (A.
