This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri K Govind, Advocate for the Petitioner and Sri M Ramachandra Reddy, learned Additional Public Prosecutor on behalf of the Respondent No.1 .

This Criminal petition has been filed by the petitioner/accused seeking to quash the proceedings in c'c'No.1344 of 2022, on rhe file of learned Additionar Judiciar First Class Magistrate at Gajwel.

Heard Mr.K.Govind, learned counsel for the petitioner and Mr'M'Ramachandra Reddy, learned Additionar pubric prosecutor for respondent No.l.

Though the criminal petition was filed seeking to quash the proceedings in C.C.No.1344 of 2022 by raising several grounds, the learned counsel for the petitioner restricted his prayer requesting this Court to dispense with the appearance of the petitioner/accused in C.C.No .1344 of 2022, on the file of learned Additional Judicial First Class Magistrate at Gajwel, on the ground that he is eking out his livelihood by doing agriculture. 4The learned Additional Public Prosecutor has not opposed the submission made by the learned counsel for petitioner. 5.

In view of the above submissions, and without expressing any opinion on the merits of the case, the presence of the petitioner/accused in C.C.No.1344 of 2022, on the file of learned Additional Judicial First Class Magistrate at Gajwel, is dispensed with, subject to the condition that he shall be represented through his counsel on each and every date of hearing. If the presence of the petitioner is required, he shall appear before the trial Court. In case of his non-appearance on the specific date fixed by the trial Court for his appearance, the trial Court is entitled to proceed with the matter, in accordance with law.

Accordingly, the criminal petition is disposed of.
