THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.7908 OF 2010 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India, seeking to declare the unfair investigation conducted by the 8th respondent in Crime No.138/ 2006 on the file of the 9th respondent and inaction of the 2nd respondent in not taking further steps pursuant to the letter C.No.1533/ C2/ 2009 dated 25/ 11/ 2009, submitted by the 4th respondent to the 2nd respondent, as illegal and arbitrary, and consequently, direct the 1st respondent to transfer above said crime to the 3rd respondent for further investigation. Heard and perused the material available on record. The 5th respondent filed counter stating that 4th respondent - Inspector General of Police, Guntur Range, addressed letter, dated 26.04.

2010, to the 2nd respondent - Director General of Police, informing that all the best efforts made by the local police to detect the case in Cr.No.138/ 2006 of Kothapet Crime Police Station went futile and as there are allegations against the husband of the deceased for killing her, the investigation of the case may be entrusted to the CBCID. Recording the stand taken by the respondent police in the counter, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, pending if any, shall stand closed.
