HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CIVIL MISCELLANEOUS APPEAL No.683 of 2005 JUDGMENT : (per Hon'ble Sri Justice R.Subhash Reddy) This appeal, under Section 28 of the Hindu Marriage Act, 1955 (for brevity "the Act"), is filed by the appellant/husband aggrieved by the order and decree dated 04.04.2005 in O.P.No.77 of 2003 passed by the Principal Senior Civil Judge, Rajahmundry, East Godavari District, dismissing the petition filed by him under Section 13(1)(ib) of the Act seeking to grant divorce by dissolving the marriage between him and the respondent/wife.

2. During the pendency of the appeal, as Sri M. Lakshmana Sarma, learned counsel for the appellant died, this Court, by order dated 26.3.2015 directed the Registry to issue notice to the appellant. Pursuant to the said direction, notice sent to the appellant is returned with postal endorsement "addressee deceased".

3. In view of the said endorsement, this appeal is dismissed as abated. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
