2.
Challenging the notice dated 14.02.2019 issued under Section 452(2) of the Greater Hyderabad Municipal Corporation Act, 1955, by the 3rd respondent, this writ petition is filed. 3.
The case of the petitioner is that without being aware of the legal implications, he was carrying on business in the temporary shed constructed in the premises bearing Nos.534 part and 535 part, admeasuring 400 square yards in Sy.No.60, situated at Sreeramana Colony, Karmanghat Village, Saroornagar. However, after receiving notice from the 3rd respondent on 29.01.2019, the petitioner submitted a reply on 04.02.2019 enclosing the relevant documents and subsequently, he had vacated the premises and as on date, temporary shed is there and no business is being carried on there. His further case is that though he approached the respondent authorities for regularization of the temporary shed, the 3rd respondent issued the impugned notice to vacate the premises. 4.
Inasmuch as the petitioner has not made any application for regularization of the temporary shed by invoking appropriate
CKR, J W.P.No.3509 of 2019 provisions of law, if any, no order directing regularization can be passed in favour of the petitioner. However, it is open to the petitioner to approach the respondent authorities seeking appropriate relief.
