This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A1, in Crime No.787 of 2017 on the file of Medipally Police Station, Rachakonda District. The offence alleged is under Section 306 IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The counsel for the petitioner submits that this petitioner is innocent and that Section 306 IPC cannot be attracted to the acts alleged against this petitioner.

The Public Prosecutor brings to the notice of this court that, earlier, this court dismissed the bail petition filed by this petitioner, by virtue of the order, dated 19.12.2017, in Crl.P.No.12204 of 2017. A perusal of the order shows, that it was dismissed on merits.

Hence, the Criminal Petition is dismissed as not maintainable. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below. The court below shall dispose of the bail application, if any filed, on merits, expeditiously, preferably on the same day, subject to the pressure of other work.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
