SMT JUSTICE T.RAJANI CRIMINAL PETITION No.1041 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner/accused, in Crime No.119 of 2017 on the file of the Mutharam (Mti) Police Station, Ramagundam District. 2.

The offences alleged are under Sections 353 and 506 I.P.C. 3.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.

The allegation, as per the complaint, against this petitioner is that he questioned the de facto complainant as to why he removed him as pump operator and by stating so he pushed him and threatened him with dire consequences.

The learned counsel for the petitioner submits that there is delay in giving report, which throws a doubt on the veracity of the contents of the complaint. But, the said delay is explained in the complaint itself, saying that the petitioner has threatened him.

Hence, considering the facts of the case, this Court opines that this is not a fit case for granting anticipatory bail. 7.

Accordingly, the Criminal Petition is dismissed. However, the petitioner/accused can file a petition seeking for regular bail by surrendering himself before the Court below. The Court below shall dispose of the bail application on merits, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
