THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD WRI T PETI TI ON No.11371 of 2016 ORDER: (Per Justice Sanjay Kumar) This writ petition was filed assailing the sale notice dated 05.03.2016 published by the State Bank of India in Hindu daily newspaper proposing to hold the auction sale of the secured asset on 13.04.2016. Sri Maruthi Jadhav, learned counsel representing Sri B.S. Prasad, learned panel counsel for the State Bank of India, would inform this Court that the sale held on 13.04.2016 pursuant to the impugned sale notice did not materialize for want of bidders.

In that view of the matter, challenge to the impugned sale notice is rendered purely academic and does not warrant consideration on merits. The writ petition is accordingly dismissed on this short ground. It is left open to the petitioner to avail appropriate remedies in accordance with law if and when a fresh cause of action arises. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
