SMT JUSTICE T.RAJANI CRIMINAL PETITION No.1047 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused No.1, in Crime No.68 of 2017 on the file of the Station House Officer, Puttaparthy Urban Police Station, Anantapur District. 2.

The offences alleged are under Sections 324, 307, 452, 427 and 506 R/w.34 of I.P.C.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.

As per the case of the prosecution, the petitioner/accused No.1 is an employee i.e., cashier in Sri Sathya Sai Towers Hotels Private Limited, belonging to the de-facto complainant, who is alleged to have stolen Rs.30,00,000/- from cash counter of the Hotel and it is also alleged that the petitioner/accused No.1 agreed in his statement that he has stolen about Rs.16,00,000/- and towards discharge of part of the amount gave a cheque for Rs.4,50,000/- and the same got dishonoured due to 'insufficient funds'.

Hence, from the above facts, it appears that this is not a fit case for grant of anticipatory bail to the petitioner/accused No.1.

However, the petitioner/accused No.1 is at liberty to surrender the before the lower Court and obtain regular bail. The lower Court shall dispose of the bail application expeditiously, on merits, preferably on the same day, subject to pressure of other work.

Accordingly, with the above observation, the Criminal Petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
