THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37295 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed to call for records pertaining to FIR No.110 of 2016, pending on the file of 3rd respondent and to quash the same.
Heard and perused the material available on record. The main grievance of the petitioners is that the 4th respondent lodged a complaint on 30.08.2016 to the 3rd respondent alleging that on 30.08.2016, on the eve of education committee elections at ZPHS School, Chinnaiahpalem, brother of the 4th respondent namely D. Ramesh went there and that at about 1.00 p.m., the 1st petitioner picked up a quarrel and abused him and that the 1st petitioner alleged to have telephoned his brother (2nd petitioner) and on that the 2nd petitioner came to the said school along with Nagaraju Yadav, Chandramohan and Venkanna and beat him with sticks for which he alleged to have received bleeding injuries on head, fore-arm and other parts of the body. Basing on the said complaint, the 3rd respondent registered the above said crime for the offences punishable under Sections 324, 506 & 307 IPC and Section 3(i)(x) of the SCs & STs (POA) Act.
Considering the grievance of the petitioners, the 3rd respondent is directed to complete the investigation in FIR No.110 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. In case, if any charge sheet is filed and summons are received by the petitioners, they shall appear before the Court concerned and execute a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) each with one surety each to the satisfaction of the concerned Court for their future appearance before the concerned Court.
Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 2nd November, 2016 KL
