HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.34847 OF 2014 ORDER:

The case of the petitioner is that the proceedings were initiated under the Land Acquisition Act, 1894 (for short "the Act") in respect of lands pertaining to the petitioner. But, no possession is taken and no award is passed as on today. Aggrieved by the same, this writ petition is filed stating that the proceedings initiated under Section the Act got lapsed by operation of Section 24 (2) of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act 30 of 2013). Now the learned Assistant Government Pleader for Land Acquisition produced written instructions addressed by the Revenue Divisional Officer to him stating that draft Notification in this case got lapsed during July, 2011 and the land can be acquired under the Act 30 of 2013.

In view of the same, the writ petition is allowed. However, this will not preclude the respondents from initiating proceedings under the Act 30 of 2013, if the need arises.

Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
