HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.11815 of 2015 ORDER:

This Writ Petition is filed seeking to issue a writ of Mandamus to declare the condition No.26(A)(15)(B) of the "Notice Inviting Tender" bearing tender No.14SE/2014-15, dated 24-03-2015 issued by the 2nd respondent relating to 'Construction of Dindi Balancing Reservoir of SLBC Tunnel Scheme across Dindi river near Mothia Thanda of Teldevarapalli Village, Chandampet Mandal, Nalgonda District', to the extent of prescribing 'the individual/firm/lead member in case of joint venture, shall have completed at least one similar work of formation of reservoir/concrete dam/earth dam with a height of not less than 25 meters having minimum capacity of 5.0 TMC during last ten financial years (2004-2005 to 2013-2014) as a prime contractor or as a lead member, as illegal and arbitrary and consequently direct the respondents to accept the tender submitted by the petitioners without insisting upon the said condition.

When the matter is taken up for hearing, Sri B.Vijayasen Reddy, learned counsel for the petitioners, submits that the grievance of the petitioners is already addressed by way of a modification in the tender condition and the same was also communicated to the petitioners.

Recording the submission made by the learned counsel for the petitioners, the Writ Petition is closed, as no orders are necessary. There shall be no order as to costs.
