HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 11104 of 2015 ORDER:

This Writ Petition is filed seeking a direction to the second respondent to pass appropriate orders either on the stay application or in the main appeal filed under Section 5 (5) of the Andhra Pradesh Record of Rights in Land and

Pattadar Passbooks Act, 1971. The said appeal is filed against the orders passed by the third respondent-Tahasildar in Proceedings No. ROR/289/2011, dated 4.3.2011.

Though in the normal course, where appeal is filed and orders are not passed on the interlocutory applications by the quasi judicial authorities, this Court keeps the order in abeyance which is challenged in the appeal, till the appeal is disposed of or interlocutory application is considered and disposed of. However in this particular case, having considered the challenge of the order dated 4.3.2011 in the year 2015, I am not inclined to pass any such order. However, in the interest of justice, the second respondent is directed to consider and dispose of either main appeal or stay application filed therewith by the petitioner, in accordance with law and after issuing prior notice to the fourth respondent herein, within a period of four months from the date of receipt of a copy of this order.

Subject to the above direction, the Writ Petition is disposed of at the admission stage.
