CVNR, J & GSP, J IA.No.1 of 2018 in/and CMA.No.79 of 2018 Dt:06.9.2018 COMMON ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Civil Miscellaneous Appeal is filed against order, dated 26.02.2016, in G.O.P.No.123 of 2015 on the file of the II Additional District Judge, Amalapuram, East Godavari District, whereby he has dismissed the said G.O.P. filed by applicant No.1/appellant No.1-the mother of applicant Nos.2 and 3/appellant Nos.2 and 3, in the latter's name as representing them, for permission to sell the G.O.P. schedule properties. As there is a delay, the appellants have filed I.A.No.1 of 2018 for condonation of delay of 631 days in preferring the appeal. After arguing the case, Mr. V.Sai Kumar, learned counsel for the appellants, submitted that his clients do not intend to press the Civil Miscellaneous Appeal as well as the application as, the father and natural guardian of applicant Nos.2 and 3/appellant Nos.2 and 3, the minor children, intends to institute a fresh proceeding before the lower Court for appropriate reliefs.

In the light of the above submission, I.A.No.1 of 2018 is dismissed and as a consequence thereof, the Civil Miscellaneous Appeal is rejected with liberty to the father and natural guardian of the minor children-applicant Nos.2 and 3/appellant Nos.2 and 3 to avail appropriate legal remedies.
