Heard Sri K.Venumadhav, learned counsel for the petitioner and learned Government Pleader for Panchat Raj and Rural Development appearing for the respondents.

The only grievance of the petitioner is for non-disposal of the stay application filed along with appeal under the provisions of Section 249 (7) of the Andhra Pradesh Panchayat Raj Act, 1994 (for short, 'the Act'). The Collector (Panchayat Wing), Nizamabad District, vide proceedings No.B5/415/2016, dated 10.11.2016, directed removal of the petitioner herein from the Office of the Sarpanch under Section 249 (1) of the Act. As against the said order of removal, the petitioner herein filed statutory appeal under Sub Section 7 of Section 249 of the Act and also filed an application seeking stay of the order of removal on the even date. The grievance of the petitioner herein in the present writ petition is non disposal of the stay application filed by him along with the said appeal, dated 26.11.2016.

Having heard the learned counsel for the petitioner and learned Government Pleader for Panchayat Raj, this Court is of the considered opinion that the ends of justice would be served if the 1st respondent State Government is directed to pass appropriate orders on the stay application, dated 26.11.2016, filed by the petitioner herein along with appeal, dated 26.11.2016, filed by the petitioner against the order of removal, dated 10.11.2016, passed by the Collector (Panchayat Wing), vide proceedings

No.B5/415/2016, dated 10.11.2016, within a period of one month from the date of receipt of a copy of this order. The 1st respondent shall also make an endeavour to dispose of the main appeal filed by the petitioner herein.

With the above direction, the Writ Petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. __________________ A.V.SESHA SAI, J APRIL 17, 2017 YVL
