The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of SRI.V.RAGHUNATH Advocate for the Petitioner and ADDL.PUBLIC PROSECUTOR (TG) for the Respondent, the Court made the following.
ORDER
THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.1200 of 2020 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused No.1 seeking to grant anticipatory bail in the event of his arrest in Crime No.178 of 2019 on the file of Bhanoor Police Station, Sangareddy District, registered for the offence punishable under Section 307 IPC
2. Heard learned counsel for the petitioner, learned Additional Public Prosecutor appearing for the respondentState and perused the record. 3.
The brief facts of the case as per the complaint are that on 24.12.2019, one Sri Mohammed Kaleemuddin, ASI of Police, recorded the statement of the injured-Yadavalli Jayapratap Reddy, which reads that he is living by running Kirana shop; that two workers are working in his shop since four years; that on 23.12.2019 around 10.10 pm after closing the said shop, he sat on the bike of the worker-Khasim and meantime, a person wearing monkey cap all of a sudden attacked him with knife due to which he received bleeding injuries on left side of head and neck, that he suspect two persons by name Buchiraju and Srinivas belonging to Bulkapuram Village who demanded for money for the accident that involved the car of the de facto complainant on 04.8.2019 in which a old aged woman died. Learned counsel for the petitioner submitted that all the allegations levelled against the petitioner are false, frivolous and concocted in order to implicate the petitioner; that no overt acts whatsoever have been attributed to the petitioner; that even as per the allegations made in the complaint, only on mere suspicion the petitioner has been implicated in this case; that the petitioner has nothing to do with the present crime; that the petitioner has neither threatened nor demanded any money with regard to any other case d5 alleged by the de facto complainant; and that the petitioner is working as a Police Constable. Learned counsel further submitted that the petitioner is a law abiding citizen and is ready to abide by any conditions that may be imposed by this Court in the event of his enlargement on anticlpatory bail
5. Learned Additional Public Prosecutor vehemently opposed to grant anticipatory bail to the petitioner. 6.
Looking into the nature of allegations levelled against the petitioner and the facts and circumstances of the case, without delving into the merits of the case, I am inclined to grant anticipatory bail to the petitioner.
7. The Criminal Petition is accordingly allowed. The petitioner is directed to surrender before the Station House Officer, Bhanoor Police Station, Sangareddy District, within a period of 15 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/accused on bail on his executing a personal bond to a
the tune of Rs.15,000/- (Rupees Fifteen thousand only) with two sureties for the like amount each to his satisfaction. Further, the petitioner shall abide by the conditions stipulated in Section 438(2) Cr.P.C and co-operate with the lnvestigating Officer in investigating the case.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
