THE HONOURABLE SMT JUSTICE P. SREE SUDHA SECOND APPEAL NO. 918 OF 2OO4 JUDGMENT:
Plaintiff has filed O.S. No.509 of 1999 on the file of Principal Junior Civil Judge, Khammam, for Permanent Injunction. The trial Court dismissed the suit. The unsuccessful plaintiff preferred appeal vide A.S.No.12 of 2003 wherein the appellate Court allowed the appeal, against which the second appeal has been filed. 2.
A perusal of the docket proceedings shows that the learned counsel for the appellant did not evince any interest to pursue the second appeal proceedings. On 08.08.2023, as there was no representation on behalf of the learned counsel for the appellant, the matter was directed to be listed under the caption 'for dismissal'. Even today also, there is no representation for the appellant. No purpose would be served in continuing the Second Appeal. 3.
Accordingly, the Second Appeal is dismissed. No order as to costs.
