HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL REVISION CASE No. 62 of 2016 ORDER:

Assailing the order dated 19.12.2015 passed in Crl.M.P. No.3116 of 2015 in Crime No.749 of 2015 on the file of the IX Metropolitan Magistrate, Cyberabad, Kukatpally at Miyapur, wherein and whereunder an application filed under Sections 451 read with 457 Cr.P.C., seeking interim custody of mobile phone and cash of Rs.1,50,000/- seized by police in Crime No.749 of 2015, was allowed in part, the present Revision is filed.

A perusal of the impugned order would show that the accused persons are alleged to have cheated several persons impersonating them as political leaders and collected money. During investigation police seized Rs.1,50,000/- and one mobile phone from the petitioner under the cover of panchanama. While granting interim custody of the mobile phone, the Court rejected the request of the petitioner with regard to release of cash. Challenging the same, the present revision is filed. The learned counsel for the petitioner submits that the petitioner is ready to give guarantee/security for the cash of Rs.1,50,000/-. Having regard to the facts and circumstances of the case, the petition is ordered by directing the petitioner to furnish Bank guarantee for an amount of Rs.

1,50,000/- (Rupees one lakh and fifty thousand only) to the satisfaction of the trial court, in which event cash of Rs.1,50,000/- (Rupees one lakh and fifty thousand only) shall be released in accordance with law. With the above direction, the Criminal Revision Case is disposed of. As a sequel to it, miscellaneous petitions pending if any, in this Revision shall stand closed.
