Petitioner was appointed as contract conductor on 24.06.2010. From a reading of the impugned order, it is clear that from 02.07.2010 petitioner was unauthorisedly absent till the order of termination was passed. In other words, petitioner has not even worked for one week before he remained absent and such absence was for more than two months. The order of termination was made on 16.09.2010 and petitioner woke up and preferred appeal in the year 2016. Rightly the competent authority rejected the appeal as time barred, since the claim was made after more than five years. However, Revision was also dismissed on the very same ground of inordinate delay and for very short period of his work.

Having regard to the above, I do not see any illegality in the order of termination and the consequential orders of the Divisional Manager and Regional Manager.

Having regard to the fact that petitioner was contract conductor and hardly worked for seven to eight days before he remained absent, this Court is not inclined to entertain the writ petition.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
