HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.19963 of 2016 ORDER:
1 . The petitioner states that he was selected by the selection committee for the post of driver in Jammalamadugu depot. He joined service on 02.08.1993 and his services were regularized with effect from 02.08.1993. However, he was found medically unfit on account of defective vision. He was given the alternative job of Conductor by order dated 23.04.2015 and also protected his pay, but the seniority of the petitioner was not protected from the date of initial appointment. In those circumstances, he filed W.P.No.33479 of 2015 and this Court disposed of the said writ petition on 12.10.2015 setting aside the proceedings of the 3rd respondent dated 23.04.2015 and directing the 3rd respondent to count the seniority of the petitioner from 02.08.1993. Now, the petitioner states that he is unable to discharge the duty of the Conductor and he fell sick from 14.09.2015 to 20.09.2015. He seeks alternative employment in view of his health condition. He submitted a representation to the 1st respondent on 02.09.2015 and when the same was not considered, the present writ petition was filed.
2. Even though notice before admission was ordered on 22.06.2016 and three weeks time was granted, no counter-affidavit is filed on behalf of the respondents.
3. In the circumstances, the Writ Petition is disposed of directing the 1st respondent to consider the representation of the petitioner dated 02.09.2015 and pass appropriate orders thereon in accordance with law within a period of three months from the date of receipt of a copy of this order. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
