Heard Sri P.Venkateshwer Rao, learned counsel appearing for the petitioner and Sri B.Mayur Reddy, learned Standing Counsel for the respondents 1 to 3-TSRTC.
2. On the charges of violating rule of the Corporation which constitutes misconduct and permitting parcel box of 2 kgs without passenger which was kept at driving seat and collecting Rs.40/- from the concerned person having cell number on the above box on route Hyderabad to Achampet
on 23-7-2014, a departmental enquiry was conducted against the petitioner and the punishment of deferment of annual increment for a period of one year which shall have effect of postponing of his future increments, besides treating the period of suspension as "not on duty" for all purposes was imposed against him. Aggrieved thereby, the petitioner preferred the present writ petition.
3. The learned Standing Counsel for the respondentsCorporation, on instructions, submits that there is an alternative remedy for the petitioner to file an appeal before the 2nd respondent. The learned counsel appearing for the petitioner submits that in such an event, the petitioner is willing to prefer an appeal.
4. Accordingly, the writ petition is disposed of directing the petitioner to file an appeal before the 2nd respondent. As the petitioner approached this Court directly without availing the appeal remedy, the Appellate Authority is directed to entertain the appeal notwithstanding the delay, if any occasioned in preferring the appeal and dispose of the appeal on merits in accordance with law within a period of 4 (four) weeks from the date of filing of the appeal. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
