THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2826 OF 2015 O R D E R:
1. This revision is filed by the petitioners-accused aggrieved over the order dated 30.10.2015 passed in C.C.No.48 of 2015 by the X Special Magistrate, Hyderabad.
2. It is the case of the petitioners-accused that the above case was coming up for the defence evidence on 30.10.2015 and on that day, the witness on their behalf was also present. But on the representation made on behalf of the complainant that the case was coming up for arguments, the defence evidence was closed. It is the grievance of the petitioners that no opportunity was given to them by the trial Court to adduce defence evidence.
3. Heard and perused the material available on record.
4. Considering the facts and circumstances of the case and the grievance of the petitioners, they are directed to file an application before the trial Court to reopen the case to adduce evidence on their behalf. On such application being filed, the trial Court is directed to reopen the case for the purpose of defence evidence, and fix a date to adduce defence evidence. On the date so fixed, the petitioners shall examine all their witnesses or adduce any defence evidence. If they fail to examine any of their witnesses or adduce any defence evidence on the date so fixed, the trial Court is at liberty to proceed in accordance with law.
5. With the above direction, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any,
shall stand closed.
