SMT JUSTICE T.RAJANI CRIMINAL PETITION No.1071 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of bail to the petitioner, who are accused Nos.2 to 5, in Crime No.196 of 2017 on the file of the Bhadrachalam Town Police Station, Bhadradri Kothagudem District.

The offences alleged are under Sections 489A, 489B, 489C and 489D r/w 34 I.P.C.

Heard the learned counsel for the petitioners, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.

The allegation as per the prosecution is that the petitioners were in possession of fake currency notes.

The learned counsel for the petitioners submits that the petitioners are innocent persons and the main allegation is only against Accused No.1.

However, the facts of the case would prima facie reveal that these petitioners were conscious of the counterfeitness of the currency notes, since they were in possession of several currency notes. Hence, it cannot be said that the petitioners were not conscious of the possession. Therefore, this Court opines that this is not a fit case to grant bail. 7.

Accordingly, the Criminal Petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand closed. ______________________ T. RAJANI, J Date: 08.02.2018.
