THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.11014 of 2004 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus, declaring the in action of the respondents in not regularizing the petitioner's Service from the date of Completion of 240 days of service from the initial date of joining the Service as illegal, unjust and in violation of Articles 14, 16 and 21 of the Constitution of India and consequently direct the respondents to regularize her service from date on which she completed 240 days of service from the initial date of service from the initial date of joining along with all consequential benefits in the interest of justice and fair play and pass such other orders.

2 When the matter is taken up for hearing, the learned counsel for petitioner seeks permission of the Court to permit the petitioner to withdraw the Writ Petition with liberty to avail the remedies available to her under law including filing of a fresh Writ Petition. Permission is accorded.

3 In the result, the Writ Petition is dismissed as withdrawn granting the liberty as prayed for.

No order as to costs. As a sequel, the miscellaneous petitions, pending in this Writ Petition, if any, shall stand closed.
