THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.26024 of 2003 ORDER:

When the matter is taken up for hearing, none appears for the petitioner inspite of the fact that the writ petition is listed under the caption 'for dismissal'.

A perusal of the record discloses that the petitioner is challenging the action of the respondents in not granting benefit of G.O.Rt.No.784 dated 25.09.2003 to the petitioner on the ground that the petitioner has not completed Multipurpose Health Assistant (Male) from a recognised institute and the respondents are extending the benefit of G.O.Rt.No.784 dated 25.09.2003 to those candidates who have completed the said course from the Government institutions but not from the Government recognised institutions. Challenging the same, the present writ petition is filed.

It is further contended by the petitioner that he has submitted a representation to the 2nd respondent on 25.11.2003 requesting the 2nd respondent to permit him to appear for the interview and thereby he has attended the interview. It is further contended that inspite of securing more marks, the petitioner was not selected on par with other candidates who are being selected for the post of MPHA (M). Therefore, he made a representation on 01.12.2003 requesting the 2nd respondent to

consider him along with the candidates who are selected for the post of MPHA (M). Since the respondents 1 and 2 have not taken any decision so far on the representation filed by the petitioner, the present writ petition is filed. This Court, after considering the submissions of both the counsel, is of the considered view that the writ petition can be disposed of directing the petitioner to submit a fresh representation to the respondents within one week from the date of receipt of copy of this order. Upon receipt of such representation, the respondent 1 and 2 shall consider and pass appropriate orders within four weeks thereafter. With the above observations, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
