This writ petition is filed challenging the action of the respondents in not paying compensation to the petitioner in respect of land admeasuring Ac.3-11 guntas in Sy.No.547/1, situated at Bhainsa Village and Mandal, Adilabad District. 2.

It is the case of the petitioner that he and his family members were the owners and possessors of land admeasuring Ac.30-16 guntas in Sy.No.547/1, situated at Bhainsa Village and Mandal, Adilabad District, having got the same by way of succession. While so, the said land was acquired for the purpose of submergence of Suddavagu Project. Though an extent of land admeasuring Ac.30-16 guntas was acquired, the respondents paid compensation in respect of land Ac.27-05 guntas only and did not pay any compensation for the balance extent of land Ac.3-11 guntas. In those circumstances, the petitioner made an application to the respondents in the year 2003 and the same was not considered. However, the third respondent has addressed a letter dated 12.10.2004 to the second respondent recommending to make the payment to the petitioner in respect of land admeasuring Ac.3-11 guntas. In spite of the same, no action has been taken by the respondents to pay the amount for the balance extent of land. 4.
The third respondent filed a counter-affidavit stating that the actual extent acquired is Ac.27-05 guntas only and payment was
made to the petitioner accordingly. The petitioner is in possession of Ac.3-33 guntas of land as per pahani copy for the year 20122013 and the petitioner is not entitled for further payment. 5.
Sri S.Bhoom Rao, learned Assistant Government Pleader, submitted that the respondents paid compensation to the petitioner for the land acquired i.e., Ac.27-05 guntas and that as the petitioner is in possession of land admeasuring Ac.3-33 guntas, he is not entitled for further payment.

In view of the above submission made by the learned Assistant Government Pleader, the writ petition is dismissed. As a sequel, the miscellaneous petitions pending if any shall stand closed. No order as to costs.
