THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.27208 of 2003 ORDER:

When the matter is taken up for hearing, learned Standing counsel appearing for the respondents informs that the petitioner is not service since 2003. Therefore, no orders can be passed in the present writ petition as the petitioner is challenging the action of the respondents in retiring the petitioner as Assistant Operator instead of Operator. This Court, on 31.12.2003 was pleased to grant interim direction directing the respondents either to accept voluntary retirement of the petitioner in the cadre of Operator or else continue the petitioner in service as Operator. As the petitioner is not working since 2003, this Court feels that this Writ Petition cannot be entertained. Hence, the Writ Petition is dismissed. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
