THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM C.M.A. No. 4264 OF 2004 JUDGMENT:

When the matter was listed before this Court on 28.06.2021, there was no representation for the appellant, as such, the matter was directed to be listed today under the caption 'For Dismissal'. In spite of the same, when the matter is taken up today, there is no representation for the appellant. In the circumstances, it is presumed that the appellant is not interested in prosecuting the matter. Accordingly, the Appeal is dismissed for default. The learned Junior Civil Judge, Alampur, shall dispose of O.S.No.49 of 1997 in terms of the order dated 20.08.2002 passed by the learned Senior Civil Judge, Gadwal in A.S.No.8 of 2001 as expeditiously as possible after hearing both the parties. Consequently, miscellaneous applications, if any shall stand closed. No costs.
