HON'BLE SRI JUSTICE S.V.BHATT W.P.No.5261 OF 2009 ORDER:

The petitioners complain against inaction in disposing of representation dated 09.02.2008, as illegal, arbitrary and unconstitutional.

The petitioner through representation dated 09.02.2008 requested for looking into alleged illegal lease in favour of Sri Sairam Zari Agencies, if necessary, take action by disposing of the representation.

I have perused the material available on record and also taken note of the submissions of leaned counsel on the alleged inaction of respondents in disposing of representation. The learned counsel are unable to state whether the representation is considered as on date or not, but however, submit that if the representation is not considered, the same can be directed to be disposed of by the respondents. Learned counsel have alternatively requested time to get instructions on the present stage of the representation. I am satisfied that instead of granting time as prayed for, the writ petition can be disposed of by this order.

The 1st respondent is directed to dispose of representation dated 09.02.2008, if not already disposed of, within two months from the date of receipt of a copy of this order in accordance with law after affording opportunity to all the interested parties. The writ petition is disposed of. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed. ____________
