THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36397 of 2016 ORDER:
In this writ petition, the petitioner seeks a writ of mandamus to declare the action of the respondents 2 & 3 in issuing the letter dated 15.6.2016 for freezing the bank account of petitioner-company bearing No.111505000551 as arbitrary and illegal an consequently, to set aside the same.
The case of the petitioner-company is that the 4th respondent company lodged a complaint with the 2nd respondent on 13.02.2016 alleging that one of the employees of 4th respondent-company in collusion with the petitioner-company along with 8 firms issued purchase orders with inflated prices and caused loss to the 4th respondent-company to a tune of Rs.5,14,01,000/-. Basing on the said complaint, a case was registered in F.I.R. No.44 of 2016 against the petitioner-company and others. During the course of investigation, on the instructions of investigating officer-2nd respondent herein, the 3rd respondent-Bank freezed the account of the petitioner-company and the same was communicated to the petitioner through letter dated 15.6.2016. Questioning the same, the present writ petition is filed. The learned Government Pleader for Home (Telangana) submitted that similar matter fell for consideration before this Court in W.P.No.7082 of 2007 and this Court by order dated 11.11.2014 dismissed the writ petition.
Heard and perused the material available on record.
This Court while dealing with the matter whether the police official-investigating agency has the authority to order for freezing of bank account, after elaborate discussion, dismissed W.P.No.7082 of 2007 by order dated 11.11.2014. In view of the same and for the reasons stated therein, the present writ petition is liable to be dismissed. Accordingly, the Writ Petition is dismissed. No costs.
