HONOURABLE JUSTICE G. SRI DEVI I.A.No.2 of 2019 In/and CRIMINAL PETITION No.1029 of 2019 ORDER:

The petitioner, who is A.4 in C.C.No.1506 of 2018 on the file of the Addl.Judicial XXV Metropolitan Magistrate Court, Kukatpalli, Cyberabad, out of Cr.No.58 of 2017, registered for the offence punishable under Section 392 IPC, basing on the complaint of 2nd respondent/ defacto-complainant, filed this Criminal Petition under Section 482 CrPC to quash the proceedings in the above Calendar Case.

Both the petitioner and the defacto-complainant along with their respective counsel present and the parties were identified by their respective counsel. When examined they stated that they intend to compromise the matter pending criminal petition and filed petitions seeking to permit them to compromise the matter and compound the offences alleged against the accused.

Perused the petition vide I.A.No.2 of 2019 filed by the defactocomplainant for permission to compromise the matter with the petitioner/ A.4 and consequently quash the proceedings in the above case against the petitioner. Along with the petition in I.A.No.2 of 2019, a joint memo signed by both the parties is filed wherein they stated that they have amicably settled the disputes between them and the defacto-complainant has no objection to quash the proceedings in the above case against the

petitioner/ A.4. The joint memo is also supported by the affidavit of the defacto-complainant.

Thus in view of the compromise between the parties settling the disputes amicably, they are permitted to compromise the matter and compound the offence alleged. The compromise is recorded.

Accordingly, I.A.No.2 of 2019 is allowed and the Criminal Petition is also allowed quashing the proceedings in C.C.No.1506 of 2018 on the file of the Addl.Judicial XXV Metropolitan Magistrate Court, Kukatpalli, Cyberabad against the petitioner. The petitioner is acquitted and his bail bonds, if any, shall stand cancelled. 6.
