THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE G. SHYAM PRASAD WRIT PETITION No.34419 OF 2016 ORDER: (Per Hon'ble Sri Justice V. Ramasubramanian) The petitioner has come up with the above writ petition challenging the refusal of the 1st respondent-bank to extend the time for payment of the dues, as per the order passed in a previous writ petition. Heard Mr. V. Ganesh Bhujanga Rao, learned counsel for the petitioner, and Mr. P. Hari Prasad, learned counsel, appearing for the 1st respondent-bank.

The interim order passed by this Court, on 06.10.2016, if extracted, would be sufficient to dispose of this writ petition also; hence, it is extracted as follows:

"........................................

Having regard to the facts and circumstances of the case, the time granted by this Court in W.P. No.30313 of 2016 dated 09.09.2016 to the petitioner for payment of Rs.40,00,000/-, is extended till 14.10.2016. Till then, the Bank shall not confirm the sale. The balance amount should be paid by the petitioner within ten days thereafter. It is made clear that no further extension will be granted."

The petitioner neither complied with the conditional order passed in W.P. No.30313 of 2016 nor the order passed in this writ petition. Therefore, the writ petition cannot, any further, survive. Moreover, the very maintainability of the writ petition is greatly in doubt. What the petitioner wants in this writ petition is an extension of time

VRS, J & GSP, J WP No.34419/2016 by the 1st respondent-bank, given on an order passed by this Court in a different writ petition.

Therefore, the writ petition is dismissed. However, it is open to the petitioner to work out his remedies before all other forums, except this Bench.

As a sequel to dismissal of the writ petition, miscellaneous petitions, if any, pending in this writ petition, shall stand dismissed as infructuous.
