THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY TRANSFER CIVIL MISCELLANEOUS PETITION No.7 of 2017 ORDER:

This transfer petition is filed under Section 24 of CPC, seeking to withdraw O.P. No.33 of 2016 from the file of the Senior Civil Judge Court, Gudiwada, Krishna District and transfer the same to the file of the Family Court, Hyderabad.

Heard the learned counsel for both the parties. 3.

A perusal of the record reveals that the marriage of the petitioner was performed with the respondent on 18.4.2000 at Sri Venkateswara Swamy Temple, Gudiwada, Krishna District, as per Hindu rites and caste customs. Immediately after the marriage, the petitioner joined the respondent to lead marital life. Out of lawful wedlock, the petitioner and the respondent were blessed with a son. Due to one reason or the other, disputes arose between the petitioner and the respondent; therefore, the petitioner has been residing in Hyderabad along with her son.

At the time of hearing, learned counsel for both the parties submitted that the petitioner and respondent are presently residing in Hyderabad. They further submitted that the matter may be transferred to the Family Court, City Civil Courts, Hyderabad. In view of the submissions made by both the counsel, this Court is of considered view that it is a fit case to allow the petition. 5.

Accordingly, the Transfer Civil Miscellaneous Petition is allowed. O.P. No.33 of 2016 is withdrawn from the file of the Senior Civil Judge Court, Gudiwada, Krishna District and transferred to the

file of the Family Court, City Civil Courts, Hyderabad, for disposal in accordance with law. Miscellaneous petitions, if any, pending in this transfer petition shall stand closed.
