Heard.
The order impugned is the one removing the petitioner from the post of Field Officer on the basis of the allegations made against her. The said impugned order also directed the petitioner to deposit the alleged misused amount of Rs.21,170/-, failing which prosecution will be launched against her.
The aforesaid order is clearly appealable to the District Collector and, hence, I am not inclined to entertain the Writ Petition. Hence, the Writ Petition is dismissed. However, the petitioner is at liberty to approach the appellate authority and make her submissions with regard to the impugned order. If and when the appeal of the petitioner is received by the 3rd respondent, he shall consider the same expeditiously and pass appropriate orders preferably within a period of three months from the date of receipt of the appeal. Pending consideration of the said appeal, if the petitioner deposits an amount of Rs.21,170/-, as per the impugned order, the same shall be treated as without prejudice to her claim in the appeal and subject to the payment of the amount, no criminal prosecution shall be launched against the petitioner. There shall be no order as to costs.
The Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
