HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.3575 of 2019 ORDER:
The prayer of the petitioners in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not recording the land details in the new pattadar pass book of the petitioner which were previously shown in the existing pattadar pass book in respect of the lands in Katha No.1599 survey Nos.667 and 668/A admeasuring Ac.0.13 Guntas and Ac.0.08 guntas respectively situated at Raikal Village, Raikal Mandal, Jagtial District, in spite of the representations on 01.02.2019 10.09.2018 and 05.11.
2018 as being illegal, arbitrary, contrary to the provisions of the Rights in Land and Pattadar Pass Books Act 1971 and consequently direct the 4th respondent to record the left out land details in the new pattadar pass book of the petitioner which were previously shown in the existing pattadar pass book in respect of the lands in Katha No.1599 survey Nos.667 and 668/A admeasuring Ac.0.13 Guntas and Ac.0.08 guntas respectively situated at Raikal village, Raikal Mandal, Jagtial District and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."
It appears that the petitioner has already been issued an e-pattadar pass book on the strength of the existing pattadar pass book and title deed issued to her under the provisions of Telangana Rights in Land and Pattadar Pass Books Act, 1971. However, it is her complaint that some of the lands covered by the existing pattadar pass book and title deed were left out while preparing the e-pattadar pass book.
The petitioner's representation dated 01.02.2019 in this regard and the earlier representations dated 10.9.2018 and 05.11.2018 are still pending consideration before the authorities. It is not open to the revenue authorities to remain inactive upon such
SK, J WP.No.3575 of 2019 Dr:21.02.2019 applications when the petitioner's entitlement to avail the benefits of Government schemes would rest upon the e-pattadar pass book. The Writ Petition is accordingly disposed of directing the Tahsildar, Raikal Mandal, Jagtial District, to take appropriate action upon the petitioner's representations dated 10.9.2018, 05.11.2018, and 01.02.2019 expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
