A perusal of the notice sent to the respondent, which is part of the record, reveals that the respondent refused to receive the notice on the ground that surname of the respondent is not correctly mentioned.

The address given in the cause title is in tune with the address in the notice sent to the respondent. Therefore, this Court deems that it is a valid service.

As the appellant is absent and did not evince any interest to proceed with the appeal, despite listing the matter under the caption "for orders", the appeal is liable to be dismissed. 5.

Under these circumstances, the Civil Miscellaneous Appeal is dismissed for default.

Miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
