THE HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CMP. No.751 of 2014 ORDER:

This petition is filed to withdraw O.P.No.72 of 2014 from Senior Civil Judge, Siddipet, and transfer the same to Senior Civil Judge, Karimnagar or any other Court having competent jurisdiction for disposal in accordance with law.

2. Wife filed this application and, according to her affidavit, her marriage with respondent was performed on 15.02.2013 at Karimnagar and, as there were attempts on her life, she escaped from attempts and living separately at her parents house. She stated that she gave a report to Women Police Station, Karimnagar, and the same was registered as Crime No.162 of 2014 and she also filed D.V.C.No.100 of 2014 and both cases are pending before Judicial Magistrate of First Class, Karimnagar. It is stated that respondent to harass her filed O.P.No.72 of 2014 before the Senior Civil Judge, Siddipet, for restitution of conjugal rights and she is a housewife and taking shelter at her parents house and she has no source of income to bear transport charges. She further stated that her parents are not in a position to accompany her from Karimnagar to Siddipet which is at a distance of 100 K.M. For these reasons, she prayed for transfer of O.P. from Siddipet to Karimnagar.

3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

4. Heard advocate for petitioner.

5. It is submitted that respondent herein is attending Karimnagar in connection of Section 498-A IPC case and D.V.C. filed by wife and no prejudice will be caused to him if O.P.No.72 of 2014 is withdrawn from Siddipet and transferred to Karimnagar.

6. Considering the reasons stated in the affidavit and also considering the convenience of wife, O.P.No.72 of 2014 is withdrawn from Senior Civil Judge, Siddipet and transferred to Family Court, Karimnagar, for disposal in accordance with law.

7. The petition is, accordingly, ordered. No order as to costs.

8. As a sequel, miscellaneous petitions pending, if any, shall stand disposed of.
