THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.5177 of 2017 ORDER:

This petition is filed under Section 482 Cr.P.C. seeking to recall the warrant issued against the petitioner in P.R.C.No.60 of 2015 on the file of the Court of Additional Judicial Magistrate of First Class, Nandigama, Krishna District.

At the time of hearing, learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the criminal petition with a liberty to file petition under Section 70(2) Cr.P.C. before the court below. 3.

In view of the submission made by the learned counsel for the petitioner, the petitioner is permitted to withdraw the petition with a liberty to file a petition under Section 70(2) Cr.P.C. If the petitioner files such a petition, the Court below is hereby directed to dispose of the same on the same day in accordance with law.
