HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.23693 of 2004 ORDER:
When the matter is taken up for hearing, learned counsel appearing for both parties submitted that in order to give quietus to this long pending litigation, this writ petition may be disposed of modifying the orders passed by the Labour Court in E.P.No.31 of 2002 in I.D.No.208 of 1990, dated 23.08.2004, to the extent of the amounts which are already deposited i.e., 50% of the amount adjudicated by the Labour Court in I.D.No.208 of 1990, which would ensure justice to both parties.
In view of the above submission, the writ petition is disposed of modifying the orders passed by the Labour Court in E.P.No.31 of 2002 in I.D.No.208 of 1990, dated 23.08.2004, to the extent of the amounts which are already deposited i.e., 50% of the amount awarded by the Labour Court in I.D.No.208 of 1990. The 1st respondent is entitled to withdraw the amount deposited, without furnishing any security, if not already withdrawn. No order as to costs.
