THE HON'BLE SRI JUSTICE T.AMARNATH GOUD M.A.C.M.A. NO.1850 OF 2006 JUDGMENT:

This appeal is preferred by the appellant questioning the order of the Motor Accident Claims Tribunal (IV Additional District Judge, FTC) Nizamabad- (for short, the Tribunal) in O.P.No.935 of 2001 dated 10.11.2005.

The brief facts of the case are that on 30.03.2001, while the appellant was traveling in an Auto bearing No.AP-11-U-2583 from Kanteshwar to Mubaraknagar and when the Auto reached Ekashilanagar, due to high speed, rash and negligent driving of the Auto driver, the Auto turned turtle. In the said accident, the petitioner sustained grievous injuries. She filed the said OP seeking compensation of Rs.1,50,000/- for the injuries sustained by her in the said accident.

In the claim petition, the respondent No.1 and 2 filed counters denying the allegations and prayed to dismiss the claim petition. 4.

After considering the oral and documentary evidence on record, the Tribunal dismissed the claim petition on the ground that appellant failed to prove that she sustained injuries. Aggrieved by the said order, the appellant filed the present appeal. 5.

Heard.

A perusal of the order reveals that the Tribunal passed a well considered order by taking into consideration all the aspects. Therefore, I see no reason to interfere with the order of the Tribunal and the appeal is liable to be dismissed.

Accordingly, the Motor Accident Civil Miscellaneous Appeal is dismissed. Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
