The petitioner challenges T.O.O.No.(CGM-HRD & Trg) Rt.No.152, dated 20-08-2009 as illegal, arbitrary and unconstitutional. On 26-08-2009 in W.P.M.P.No.23417 of 2009, this Court ordered that the promotions of respondents 3 and 4 are subject to further orders in this behalf.

Respondents 1 and 2 filed W.V.M.P.No.4022 of 2010 praying for vacating the said interim order.

Learned counsel appearing for respondents submits that the case of petitioner was not considered, for disciplinary enquiry into the charges framed against the petitioner was pending and that through Memo No.CGM (HRD & TRG)/DE/DC/107-R/2007-13, dated 10-02-2010, major punishment was imposed. The punishment was challenged by way of appeal. The appeal was also rejected and there was just and proper reason for not promoting the petitioner. It is further submitted that the Department has followed the procedure of sealed cover in the case of petitioner and as finally the punishment was imposed, there was no occasion to open the sealed cover.

The submissions are placed on record and this court is of the view that having regard to above reasons, the petitioner is not interested in working out the writ prayer.

Accordingly, the writ petition is dismissed. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed. _____________ S.V. BHATT, J Date: 06.04.2016 Prv
