HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.8125 OF 2017 ORDER:

The case of the petitioners is that they are the owners of the land in Sy.Nos.56, 115, 115, 117, 94/1, 32 etc, Padmajiwadi Village, Mudegam Village and Timmapur Village, Sadashivanagar Mandal, Kamareddy District. While so, the Electricity Department without prior notice to the petitioners and without initiating acquisition proceedings started laying High Power Transmission Lines. Due to installation and erection of transmission towers, the petitioners suffered heavy crop damage and loss. But the respondents failed to determine the loss and fix the compensation following the provisions of Sections 67, 68 and 164 of the Electricity Act 2003 and the Rules made thereunder. Later the petitioners made a representation on 06.02.2017 before the 1st respondent requesting to consider their case, for payment of compensation as per the guidelines issued by the Ministry of Power, Government of India on 15.10.2015. As no action has been taken, the present writ petition is filed.

Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue. In view of the above facts and circumstances, the 1st respondent is directed to consider the representation of the petitioners and dispose of the same in accordance with law, after issuing notice to the affected parties. The said exercise

shall be done within a period of three (03) months from the date of receipt of copy of this order.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 08.03.2017 dv
