HON'BLE JUSTICE G. SRI DEVI WRIT PETITION No.3616 of 2020 O R D E R :

This Writ Petition is filed seeking Mandamus to declare the action of respondent No.3 - SHO, I.T. Corridor Police Station, Cyberabad, in registering Crime No.14 of 2020 against the petitioners/A.1 to A.4 for the offences punishable under Sections 498-A and 506 of IPC and Sections 3 and 4 of Dowry Prohibition Act, as arbitrary and illegal, and consequently sought a direction to the respondent police authorities to quash the said proceedings against the petitioners.

Though learned counsel for the petitioners/A.1 to A.4 filed the present writ petition for quashing of proceedings in Crime No.14 of 2020, he restricts his prayer seeking a direction to the Investigating Agency to follow the procedure prescribed under Section 41-A Cr.P.C. and the guidelines prescribed by the Apex Court in Arnesh Kumar v. State of Bihar and another1.

The learned Government Pleader for Home would submit that the directions of the Apex Court have to be followed and implemented.

GSD, J W.P.No.3616 of 2020 In that view of the matter, this Writ Petition is disposed of directing the respondent police authorities to abide by the directions of the Apex Court as set out in Arnesh Kumar's case (supra). However, no coercive steps shall be taken against the petitioners/A.1 to A.4.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
