THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 22806 of 2003 ORDER :
This writ petition is filed seeking a Writ of Mandamus declaring the action of the respondents in not notifying the Standard Schedule Rates for the years 2002-03 and 2003-04 and for subsequent years, on par with the notifications of Government of Andhra Pradesh, as illegal and arbitrary and consequently to direct the respondents to extend the Standard Schedule Rates as notified by the Government for the years 2002-03, 2003-04 and onwards, till the services of the petitioner are absorbed in the appropriate cadre.
It is contended by the petitioner that Standard Schedule Rates were being paid to the contract employees upto 2001-02. Thereafter, the respondent-Corporation was not extending the Standard Schedule Rates.
When the matter is taken up for hearing, it is noticed that this Court vide orders dated 18.6.2004 had dismissed the W.P.M.P. No.28573 of 2003 which was filed seeking to implement the S.S.R., with an observation that in the absence of such a decision no legal or enforceable right inhares in the petitioner to claim the relief sought herein, this application, at present, is misconceived and is accordingly dismissed.
Learned counsel appearing for the petitioner could not demonstrate that as to how the Standard Schedule Rates notified by the Government of Andhra Pradesh are applicable in respect of
the contract employees of APSRTC. In the absence of the same, no direction can be given to the respondents to implement the Standard Schedule Rates in respect of the contract employees. Apart from that, it has been pointed out by learned counsel for the petitioner that the petitioner is seeking Standard Schedule Rates only for the contract services rendered by him and subsequently his services were also regularized. The fact of subsequent regularization of the services of the petitioner has been confirmed by learned Standing Counsel.
Therefore, the Writ Petition is dismissed. No order as to costs.
Miscellaneous petitions, pending if any, shall stand closed. No order as to costs.
