THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO CONTEMPT CASE No.2447 of 2015 ORDER:

Petitioners had filed this Contempt Case alleging willful disobedience of the order passed by this Court on 16-10-2014 in W.P.M.P.No.38703 of in W.P.No.30953 of 2014.

2. Petitioners had alleged in the Writ Petition that certain shops or a temple was being constructed on G.T. road by 6th respondent without obtaining any permission from respondent Nos.2 to 5 in the Writ Petition. So, this Court granted an interim direction directing respondent Nos.1 to 5 in the Writ Petition to stop the construction of shops on the pretext of Sri Ram Mandir being made by 6th respondent. 3.

Since basis of this order was that the construction sought to be made by 6th respondent is on the G.T. road, and since no material is placed by petitioners before this Court to show that the construction being taken up by 6th respondent is on such road, and since respondent Nos.1, 2 and 5 have filed counter-affidavits stating that the construction is being made by 6th respondent in the Writ petition, who is

5th respondent herein, in his private land and not on the G.T. road or in the road margin, it has to be held that there is no willful disobedience by respondent Nos.1 to 4 herein of the order passed by this Court on 16-10-2014.

4. Therefore the Contempt Case is closed. No costs.

5. As a sequel, miscellaneous petitions pending if any, in this Contempt Case shall stand closed.
