THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE T. AMARNATH GOUD WRI T PETI TI ON No.33650 of 2017 ORDER: (per Justice Sanjay Kumar) The petitioner seeks a Writ of Habeas Corpus to produce his daughter, Bandaru Gayathri, before this Court and to set her at liberty forthwith.

Learned Assistant Government Pleader attached to the office of the learned Advocate General, State of Andhra Pradesh, informed this Court that the alleged detenu, Bandaru Gayathri, is present in Court. Thereupon, we interacted with her and she produced her Aadhar Card in proof of her identity. The said Aadhar Card indicates that she is a major as on date as her date of birth is shown as 08.12.1995. Upon being questioned, she informed the Court that she is willingly staying with her in-laws at Eepurupalem, Prakasam District, and that she married Mallela Srinivas. Though Sri N. Ravi Prasad, learned counsel for the petitioner, would contend that the said marriage is not legal as Mallela Srinivas is already married, we are not concerned with the said issue in this case. Once the alleged detenu stated that she is a major and that she is willingly staying away from her parents, she cannot be compelled to return to her parental home.

The writ petition is therefore devoid of merit and is accordingly dismissed. No order as to costs.
