Challenge in this appeal is the judgment and decree which was rendered by Senior Civil Judge, Khammam in O.S.No.129 of 1999, dated 03.10.2002.

In view of the death of counsel for the appellant Sri M.Rajamalla Reddy, a notice was directed to the parties and accordingly, notice was sent to the appellant, none represented the appellant. Today, when the matter is posted under the caption "for dismissal", yet, there is no representation for the appellant. It seems appellant has no interest to proceed with the appeal.

Hence, this appeal is dismissed for non-prosecution. 4.

As a sequel, pending Miscellaneous Applications, if any, shall stand closed.
